Private Judging is an ADR process whereby the parties retain the services of a neutral to serve as a private judge. The private judge hears the case and makes a decision in a similar manner to a judge in a court trial. A written memorandum of decision can be issued, or a ruling rendered in the form preferable to the parties. The procedures and applicable rules of evidence are agreed to by the parties in advance. Though similar to arbitration, this is a different and distinct method for resolving disputes which utilizes features similar to a formal trial.
